Focus on Dispute Resolution – what will it cost?
All solicitors get asked this question – and whilst Progression can provide estimates on all legal matters and, in some instances, fixed fees, Dispute Resolution matters are sometimes difficult to give a specific and exact cost at the outset.
For example, a Will or Lasting Power of Attorney is likely to will take a specific amount of time and follow specific format; the same with the sale or purchase of a property so we can provide an estimate (subject to any complexities that arise) but Dispute Resolution has so many factors that can affect the costs. These include:
- What is the dispute about?
- Is it complex or simple?
- What is the value of the claim? Can you value the claim?
- Can it be settled without the issue of Court proceedings?
- Do you need expert evidence?
- Do you need a barrister?
- Are you willing to mediate?
At Progression, we take your full instructions on the issue and will guide you through the process, providing you with estimates for each stage and an overall estimate of the costs – both if it goes smoothly and if it does not. Sometimes, we may have to amend our estimate because of circumstances that are unforeseen, but we will keep you as informed as possible throughout the matter.
We can also provide you with guidance on the fees that you may be able to claim from your opponent if you are successful following changes made to the Court structure.
