Legal Rights in England for Civil Partnerships and Same-Sex Marriages

In England, same-sex couples have two main options for legally recognising their relationship. They can either get married or form a civil partnership. Both offer strong legal protection and are largely equal in the rights they provide, allowing couples to choose the option that best suits their personal values and circumstances.
Same-sex marriage became legal in 2014 under the Marriage (Same Sex Couples) Act 2013. This grants married same-sex couples the same legal status as married opposite-sex couples which provides them with automatic inheritance rights, tax benefits such as inheritance tax exemptions, pension rights, and legal protection if the relationship ends and they decide to divorce.
Civil partnerships were introduced earlier, in 2005, and extended to opposite-sex couples in 2019. Legally, civil partnerships offer almost identical rights to marriage. Civil partners enjoy the same financial protections, parental rights and inheritance benefits as married couples.
The main difference is that marriage can be religious or civil, while civil partnerships are strictly civil. Additionally, civil partnerships are not as widely recognised internationally. Ending a relationship also uses different legal terms: marriages end through divorce, while civil partnerships end through dissolution, although both follow the same process.
Importantly, both marriage and civil partnership provide far greater legal security than simply living together. Unmarried cohabiting couples do not receive automatic rights to inheritance, pensions, or financial support.
Ultimately, the choice between marriage and civil partnership is personal. From a legal perspective, both options offer legal protection and recognition under English law.
